Hate crime and harassment based on prejudice

Information in relation to harassment based on prejudice.

In Scotland, the law currently recognises 'hate crimes' as motivated by prejudice based on:

  • race,

  • religion,

  • disability, sexual orientation,

  • transgender identity

Current hate crime legislation allows any existing criminal offence to be aggravated by prejudice in respect of one or more of the characteristics of race, religion, disability, sexual orientation and transgender identity.
