Civil partner owner occupiers and the law on relationship breakdown

Civil partnership law

The Civil Partnership Act 2004 makes provision for the resolution of disputes between civil partners. The Act gives civil partners the right to apply to the court for orders regulating occupation of the family home, supplementary orders and orders apportioning to payment of joint expenses relating to the family home before dissolution of the civil partnership.

The Civil Partnership Act amends the Family Law (Scotland) Act 1985 to make provision for the division of property on the dissolution of the civil partnership.

Property law

Property law in this context is derived from both the common law and statutes such as the Conveyancing and Feudal Reform (Scotland) Act 1970.
