Applicant cannot secure entry to the accommodation
Section 24(3)a of the Housing (Scotland) Act 1987 also defines as homeless someone who has accommodation but cannot secure entry to it.

Cannot secure entry
Examples of this include being illegally evicted by the landlord, or if the accommodation is flooded. Even if legal remedies are being sought, assistance should be provided, including temporary accommodation if the applicant is unable to gain immediate access.
