Tackling Mortgage Repossessions - working with the new legislation

This one-day Shelter conference, held in Glasgow on 17 June 2010, looked at implementation of the Home Owner and Debtor Protection (Scotland) Act 2010, due to come into force in September.

Morning plenary sessions

Graeme Brown, Director, Shelter Scotland, chaired the event and the first plenary session focused on the new landscape for mortgage possessions. Stephen Sandham, Head of Homelessness, Housing Support, Advice & Standards at the Scottish Government gave the first presentation, outlining the background to the Act and its key components.

The second plenary session looked at the broader picture in providing support for struggling homeowners. Jon Pearson, Manager, Small Firms & Contact Division, Financial Services Authority, outlined proposed measures to build on regulation of mortgage providers, particularly on responsible lending and fair treatment of mortgagees who get into difficulty. Gavin Corbett, Head of Policy, Shelter Scotland gave an advice agency’s perspective on the HODP Act and associated measures. Keith McDowell, Co-ordinator of the Scottish Government Home Owner Support Fund, focused on assistance available to homeowners through the Mortgage to Rent and Mortgage to Shared Equity Schemes.

Afternoon plenary session

The afternoon session looked at the practical implications of the Home Owner and Debtor Protection Act. Eric Cumming, Policy Advisor with the Scottish Court Service, outlined the main changes in the Sherriff Courts resulting from the Act. Rob Aberdein, Partner with Aberdein Considine & Company looked at the strengths and weaknesses of the Act from the perspective of lenders and Alan McIntosh, Social Policy Officer with Money Advice Scotland gave an overview of key issues for the advice sector, focusing on lay representation.

Afternoon workshops

The event ended with facilitated discussion on two topics:

  • Resources and skills needed for organisations planning to undertake lay representation for mortgage repossessions cases
  • Likely overall impact of the Home Owner and Debtor Protection Act on the different sectors involved.
