Other rights of tenants with short Scottish secure tenancies

A tenant who has been given a short Scottish secure tenancy will have very similar rights to a tenant with a Scottish secure tenancy.

Rights in a short Scottish secure tenancy

For the duration of the short Scottish secure tenancy, a qualified person cannot succeed to their tenancy, and there is limited security of tenure. [1]

All other aspects of their tenancy will have the same rights as a Scottish secure tenancy tenant. This means that the Scottish secure tenancy legislation will apply equally to the short Scottish secure tenancy in relation to:

  • repairs

  • assignations, exchanges and sublets

  • rent increases

  • changing the tenancy agreement

  • right to information

  • compensation for work the tenant has done to the property

  • joint tenants

  • abandonment.
